Timescale

The timeline for assigning a commercial lease can vary from weeks to months depending on the complexity of the lease and the other parties involved in the matter.   If the other parties are slow in responding then the process will naturally take longer.  Also, there are many other reasons on why an assignment of lease may longer to complete, for this reason it is difficult to give a definitive answer on how long you case may take to complete

The key stages of assignment will vary depending on whether we are acting for the buyer, seller or Landlord  in the assignment.

1. Taking your instructions and giving you advice accordingly
2. Requesting for draft papers and confirmation to the seller solicitors(if applicable)
3. Reviewing the lease agreement
4. Obtaining relevant documents such as the existing lease, title documents, etc ( if applicable )
5. Obtaining the Landlord’s consent ( if applicable )
6. Completion of dealing with the lease
7. Post completion formalities e.g. submitting SDLT return and registration of the lease ( if applicable )
