The legal fees and disbursements below are an  outline guide as the exact fees is tailored depending on the facts and the circumstances of the case.

Legal fees are the fees which will be required to paid by you for the work undertaken on your file as per you instructions, from start to closure of your file.

Our standard fees for an uncontested probate matter is between £2,000.00 –  £5,000 plus VAT(20%), In total  between £2,400.00  – £6,000 inclusive of VAT)

Our standards fees estimated above is only applicable for estates where:

  • There is a valid Will
  • There is no more than one property.
  • There are no other intangible assets.
  • There are no issues with the title register of the property
  • The number of beneficiaries are only between 1 -2
  • There are no claims made against the relevant estate
  • There are no disputes between the beneficiaries
  • There is no inheritance tax to pay and the executors do not need to submit a full account to HMRC.

Please note, that the above is a non exhaustive list as it will depend on the facts of the case and complexity.

 

Key stages

Key stages in the probate process

The stages of uncontested probate can vary depending on the circumstances. However, we have set out some of the key stages of a standard probate matter:

  • Identify the legal executors or administrators and the beneficiaries of the estate.
  • Identify the probate application required for estate.
  • Meeting with the executors or the relevant family members to takes instructions and discuss the probate process.
  • Gathering details of the assets and liabilities of the estate
  • Preparing the relevant probate application and inheritance tax return.
  • Making a application to the Probate Court
  • Collecting the deceased assets and settling any liabilities
  • Distributing the estate and settling any tax payable on the estate.

 

Timescales

How long will the administration of the Estate take?

Estates which fall under uncontested probate are normally dealt within 6- 12 months time.

Generally, obtaining the grant of probate can take 6 – 8 weeks or may be even longer due to the probate registry delays in processing applications.

Further, collecting assets can take between 16 – 32 weeks. Once the assets have been collected then the distribution of the assets will take place, which can generally take 32 – 48 weeks.
